Welcome to Nafnti®. These Terms of Service ("Terms") govern your access to and use of the Nafnti website, our smart bird feeder hardware ("Hardware"), and the Nafnti mobile application ("Nafnti app") (collectively, the "Services").

PLEASE READ THE ARBITRATION PROVISION IN SECTION 15 CAREFULLY, AS IT REQUIRES YOU TO RESOLVE DISPUTES WITH NAFNTI ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION.

1. Acceptance & Communications

TL;DR: By using our products, you agree to these rules. We might send you bird-watching tips and offers, but you can opt out anytime.

  • Acceptance: By creating an account, purchasing Hardware, or using our Nafnti® app, you agree to be bound by these Terms.

  • Marketing Communications: By providing your email or phone number, you agree to receive newsletters or marketing materials from Nafnti. You may opt-out at any time by following the "unsubscribe" link in our emails.

2. Eligibility & Account Security

  • Age: You must be at least 13 years old to use the Services. Users under 18 require parental consent.

  • Responsibility: You are solely responsible for protecting your account credentials and for all activities that occur under your account.

3. Intellectual Property & Your Content (UGC)

TL;DR: Your bird videos belong to YOU. We only use anonymized clips to help our AI get smarter at recognizing 10,000+ species.

  • Nafnti Property: All AI algorithms, software, and species databases are the property of Nafnti.

  • User Ownership: You retain full ownership of photos and videos captured by your Nafnti device.

  • AI Training License: You grant Nafnti a limited, anonymized license to use media content solely to improve our 10,000+ species identification AI. You may opt-out of this sharing in the Nafnti app settings.

  • The name Nafnti®, the logo, and all related names, logos, product and service names, designs, and slogans are trademarks of or its affiliates or licensors.

4. Hardware Installation & Risk of Loss

TL;DR: Once we hand your package to the carrier (like FedEx, UPS), they are responsible for the delivery. Please install your feeder securely!

  • Technical Specs: Hardware features include dual-band 5GHz/2.4GHz WiFi, a 5200mAh battery, and a 3W solar panel.

  • Risk of Loss: All Hardware purchases are made pursuant to a shipment contract. This means the risk of loss and title for items pass to you upon our delivery to the carrier (e.g., FedEx, UPS).

  • Installation: Nafnti is not liable for damage caused by improper mounting or weather conditions exceeding our IP65 waterproof rating.

5. Subscription Services, Billing & Taxes

  • Trials: New Hardware includes a 30-day free trial of AI recognition and cloud storage.

  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the period ends.

  • Local Storage: You may use a TF card (up to 256GB) for local recording without a subscription fee.

  • Taxes: Prices displayed do not include sales tax. Nafnti will automatically calculate and charge applicable sales tax based on local tax laws.

6. AI Performance Disclaimer

TL;DR: Our AI is great, but not perfect. It's meant for fun and learning, not scientific proof.

  • While our AI identifies over 10,000 species, accuracy depends on lighting, movement, and camera angle.

  • AI identification is provided for educational and entertainment purposes only and does not constitute a scientific guarantee of species accuracy.

7. Accessibility (ADA Compliance)

Nafnti is committed to making our website’s content accessible to everyone. If you have difficulty viewing or navigating this site, please contact us at support@nafntibird.com

8. Privacy & Data Security

Your use of our Services is governed by our Privacy Policy. We implement AES-256 encryption for data at rest and HTTPS/TLS for data in transit. Requests for account deletion will be processed within 30 days.

9. Returns & Limited Warranty

Please refer to our Refund Policy for details. Unauthorized disassembly of the camera module or solar roof will immediately void your warranty.

10. Prohibited Conduct

You agree not to reverse-engineer our software, use the Services for illegal surveillance, or interfere with our security features.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS." NAFNTI DOES NOT GUARANTEE UNINTERRUPTED SERVICE DUE TO THIRD-PARTY INTERNET OR WIFI FACTORS.

12. Limitation of Liability

To the maximum extent permitted by law, Nafnti's total liability shall not exceed the amount paid by you for the Hardware or the current subscription term.

13. Indemnification

You agree to indemnify, defend, and hold harmless Nafnti from any claims, liabilities, or expenses arising from your misuse of the Services or violation of these Terms.

14. Governing Law

These Terms and any disputes arising from them are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

15. Dispute Resolution & Class Action Waiver

TL;DR: If we have a disagreement, we'll settle it through private arbitration, not in a courtroom or as a group lawsuit.

  • Arbitration: All disputes will be resolved through binding individual arbitration instead of in court.

  • Class Action Waiver: You waive the right to participate in any class-action lawsuit or class-wide arbitration.
